Terms of Use

1.The platform and the Operator

Desejo IA is an AI companion platform intended exclusively for adults aged 18 or older, available in Brazilian Portuguese, English and Spanish, operated by Alfa Engenharia de Software Ltda., a Brazilian limited liability company registered under CNPJ no. 47.250.542/0001-86, with its registered office at R. Sete de Abril, 264, 4th floor, suite 410, Centro, São Paulo/SP, ZIP code 01.044-904, Brazil (hereinafter "Desejo IA" or "Operator"). The platform provides fictional characters generated by artificial intelligence. The User may exchange messages with them, receive images, videos and audio, take part in voice calls, and create characters of their own.

All characters on the platform are fictional and depicted as being 18 years of age or older. They do not represent real people and should not be confused with them.

2.Minimum age: 18 years

The platform contains explicit adult content. Its use by minors under 18 is prohibited. By creating an account, the User represents, under penalty of law, that they are 18 years of age or older.

If it is identified, or there is reasonable suspicion, that the User is under 18 years of age, the Operator will immediately close the account, delete the data pursuant to the LGPD and, where applicable, report the case to the competent Brazilian authorities (the Federal Police, the Civil Police, the Public Prosecutor's Office and the Disque 100 hotline), as well as to recognized reporting channels.

3.Accounts

• The User is fully responsible for safeguarding and keeping their access credentials confidential. Any operations carried out using their credentials will be attributed to them.
• Each User may maintain only one active account. Creating multiple accounts for the purpose of circumventing limits, plans or bans is prohibited.
• The User may close their account at any time, through the platform settings or via a request sent to contato@desejoia.com. In the event of voluntary closure, the remaining Hearts balance is not refundable.

4.Content generated by artificial intelligence

The characters made available on the platform are generated by artificial intelligence models. Notwithstanding their degree of realism, the characters are fictional and bear no correspondence to real people. The creation of characters by the User consists of customizing traits that guide the generation, and does not constitute the recreation of existing people.

Any attempt to generate content involving the following is strictly prohibited:

• Identifiable real people (including, without limitation, celebrities, ex-partners, personal acquaintances or any identifiable third party). Such conduct constitutes a deepfake, an unlawful practice subject to criminal liability.
• Minors under 18, even if described as fictional characters. Any such violation results in a permanent ban and a report to the competent authorities.
• Non-consensual sexual violence, abuse, torture or other crimes against the person.
• Animals and other non-human species in a sexual context (bestiality).

The Operator uses automated measures and human review to detect prohibited conduct. Any confirmed attempt results in a ban without prior notice and does not prevent the Operator from reporting the case to the authorities.

5.User messages and prompts

The messages exchanged by the User with the characters are processed by the platform's artificial intelligence systems for the purpose of generating responses. Messages are stored for the following purposes:

• Operation of the character's conversational memory.
• Investigation of any reports of platform abuse.
• Compliance with legal retention obligations, where applicable.

The User grants the Operator a limited, non-exclusive and revocable license to process prompts and messages, exclusively for the operation of the service. The Operator does not use User content to train third-party open models without express consent.

6.Hearts, plans and payments

• The Hearts constitute an internal virtual currency, used to send messages, generate images, videos and audio, make voice calls, and unlock premium content. Hearts have no monetary value outside the platform, are not convertible into money, and are neither transferable nor assignable between accounts.
• The subscription plans are renewed automatically. The User may cancel the renewal at any time, in which case access will be maintained until the end of the period already paid for. Cancellation does not give rise to any right to a proportional refund.
• One-off purchases (top-ups) of Hearts are one-time transactions. Once the Hearts are credited there is no refund, except in the cases set out in the Brazilian Consumer Protection Code (art. 49, the 7-day right of withdrawal for off-premises purchases, provided that the Hearts have not yet been used).
• Payment methods: Pix and credit card. Payment data is processed by a third-party gateway regulated by the Central Bank of Brazil. The Operator does not store card data.
• In the event of chargebacks deemed improper, the account may be suspended as a precaution while the dispute is open, and is reactivated once the dispute is settled.

7.Prohibited conduct

To preserve the security and integrity of the platform, the User is prohibited from:

• Attempting to generate any of the content described in Section 4.
• Sharing, selling or publishing the media generated in their account outside the platform, without express authorization.
• Employing reverse engineering, scraping or attempts at unauthorized access to the APIs and infrastructure.
• Using bots, automation or multiple accounts for the purpose of circumventing limits.
• Engaging in harassment, threats or defamation against other users or against the Operator's team.
• Engaging in any illegal activity or activity contrary to public morals.

A confirmed violation leads to measures that range, depending on severity, from a warning to a permanent ban, with no refund.

8.Intellectual property

The source code, design, trademarks, logos and other assets of the platform are owned by the Operator or its licensors. Media generated in the User's account is for personal use and may be viewed, downloaded and stored privately. However, the User is prohibited from:

• Republishing them on other platforms, adult or otherwise.
• Selling or licensing them to third parties.
• Using them to train other artificial intelligence models.

9.Disclaimers and warnings

• The platform does not replace professional medical, psychological, legal or financial advice. If the User is in emotional crisis, they should seek professional help. If there is a risk to life, contact local emergency services, or in Brazil the Centro de Valorização da Vida (188).
• Artificial intelligence may generate inaccurate, inappropriate or inconsistent responses. The User should not base important decisions on interactions with the platform's characters.
• The service is provided "as is", and may experience instability, scheduled maintenance and changes.

10.Limitation of liability

To the maximum extent permitted by Brazilian law, the Operator shall not be liable for indirect damages, loss of profits, loss of data or other consequences arising from the use or inability to use the platform, except in cases of willful misconduct, gross negligence or violation of consumer rights.

11.Account termination

The Operator may suspend or close the User's account at any time in the event of a violation of these Terms, fraudulent activity or a legal requirement. If the account is closed for a serious violation, the remaining Hearts balance and any active subscription are forfeited, with no right to a refund.

12.Changes to these Terms

Material changes will be communicated with a minimum notice of 30 (thirty) days, by email and/or notice on the platform. Continued use after the new version takes effect implies tacit acceptance. In case of disagreement, the User may close their account.

13.Applicable law and jurisdiction

These Terms are governed by Brazilian law, notably the Consumer Protection Code (Law 8.078/90), the Brazilian Internet Act (Marco Civil da Internet, Law 12.965/14) and the General Data Protection Law (LGPD, Law 13.709/18).

The courts of the District of São Paulo/SP are hereby elected to settle disputes arising from these Terms, without prejudice to the consumer's right to choose the courts of their own domicile.
